Change the approved office space in building F to retail. 2. Add a patio to the restaurant. 3. Change a certain square footage of office space to retail for a beauty salon which is considered retail. Mrs. Hurd asked what kind of retail was going in building "f". Mr. Deslauriers said it would be a clothing store. Mrs. Maher asked if there was a difference between waiving spaces for office and waiving for retail. Mr. Deslauriers said that he felt with retail there was more of an argument for waiving spaces because their busy time was on the weekend and that is when the office space is closed. Mr. Deslauriers said that the patio would only be used in the summer and in good weather. Mrs. Maher said that she felt they would turn it into a year round greenhouse. Most felt that they would have to come back if they were going to turn it into a greenhouse. Mr. Deslauriers said that the actual size of the patio addition is 350 squc:refeet and not 900 as described. Mrs. Peacock asked if there were any standards for how much should be waived in commercial developments. Mrs. Lafleur said that there are some standards that the Urban Land Institute puts out for how much can be safely waived but they are very complicated and the City has never used them. She said that she will review them for final plat. Mrs. Peacock said that she is not opposed to the concept. In a poll of the commissioners, none opposed shared parking. Mrs. Maher said that she would be interested in any information Mrs. Lafleur could obtain on this. Mr. Burgess said that he had seen cars coming out the entrance here. Mr. Deslauriers said that they were working on the signs to•make it clearer where the exit is. Mrs. L,,Nfleur asked if the commissioners had any opposition to the patio expansion. None did. Mr. Deslauriers said that he wanted it understood that he was building a small addition also on the side of the restaurant to house the dumpster. None objected. Mr. Deslauriers said that they had to make a sight change on the location of the sidewalk so that the two sides would be directly across from each other with the entrance drive in between. fie said that Mr. Audette had refused to accept the sidewalk for the City because it was not according to plans. Mr. Jacob asked Mrs. Lafleur to find out the whole story from Mr. Audette and put the correct sidewalk location on the final plat. 5. He said that the only variance they needed was for set back in the conservation zone (the Interstate). Everything else is in conformance. He said that he was going before the Zoning Board on May 9th. Mrs. Maher noted that it was all single family homes in the area and all the variances that were given were for single family homes. Mr. Deslauriers said that they were designing the building to look like a single family home and that the area was zoned for multi -family homes. It looks like a two story colonial with a breezeway off the side. Mrs. Maher asked why the plan was here before going to Zoning. Mrs. Lq'Fleur said that it was usual to have a sketch plan review before going to Zoning. Mr. Deslauriers said that half the lot was under a Green Mountain Power easement which means that you can't put any building on the northern part of the lot. The parking is on the northern side. Mrs. Maher asked if there was a house on the property marked "Crabbe". Mr. Deslauriers said there was. Mrs. Maher noted that this lot was surrounded by single family homes and he was proposing a triplex. Mrs. Hurd asked where the entrance was to the Crabbe home. Mr. Deslauriers said that there was a right-of-way across his lot that was graveled. The neighbors who were present said that Mr. Crabbe maintained it himself and the City did not plow it. Mrs. Barbara Pell, a neighbor, said that she had been told by the City all along that this area was single family houses only and she was opposed to puting a multi -family home in here. Mrs. Maher said that she was opposed to the idea of a plan coming before the commission before it goes to Zoning. Mrs. L.+fleur said that the neighbors abutting would be notified both for the Zoning Board and the Mrs. Yandow said that the neighbors concerns were for the amount of traffic this triplex would create. Mrs. Lctfleur said that Mr. Symanski wants the road extended the length of this property, built to city standards and deeded to the City. Mrs. Hurd asked if this is the lot that was involved in the land swop. Mr. Deslauriers said it was. Mrs. Maher asked about the set back from the interstate. Mrs. Lctfleur said that buildings had to be 150 feet tack from the right-of-way of the Interstate but that all of these homes had been given variances. Mrs. Hurd asked why there was a set back if it was always allowed to be built in. Mr. Deslauriers said that most of the houses were there before the set hack was put in place. Mrs. Lafleur said that they were allowed to put a maximum of 3 ui)tlt5 , on this lot if they got the variance from the set back. Mrs. Lafleur said that if the City manager told them that, he was incorrect. Mrs. Pell said that she was afraid that the road would be pushed through to the apartments on the other side and then the traffic would increase substantially. She asked how many people could be in a triplex. Mrs. Lafleur said that the ordinance says that a maximum of 5 unrelated people could be in each unit. Mr. Deslauriers said that they were not planning to rent to the type of people who would destroy the building. He felt that it would be better to have people in here who would maintain the property. In a poll of the commissioners most agreed that three units was too much for a neighborhood of single family houses. Mr. Deslauriers asked if it wasn't his legal right to have three units. Mrs. Lafleur explained the subdivision criteria that the building had to fit the existing character of the neighborhood. Mr. Deslauriers said that he would like the chance to address the sub -division criteria. Mrs. Lafleur said he certainly could at ! ncl okc N review. In the discussion that followed Mrs. Lafleur said that the fire chief wanted an area large enough to turn around a truck. Mr. Deslauriers said that he didn't think he should be required to extend the road the length of the lot. Mrs. Lafleur said that if there were three total units on a road, the road must be brought up to City standards. Mrs. }curd said that if they built a single family home she would consider allowing a shorter length. Mr. Deslauriers said that he could build a turn around without paving the full length. Mrs. Hurd asked the applicant to be sure to show on his plan what was existing for a road and what lie planned to do. 6. other business Mrs. Lafleur brought the Planning Commission up to date on the status of the case of Heathcote vs. the Planning Commission. Heathcote has hired a traffic engineer to do a study to show that the parking standards the City had were excessive. As there was no further business to come before the Commission, the meeting adjourned at 10:00 pm. Clerk Memorandum March 15, Page 4 - Planning 1988 Traffic: The developers originally approved 48,000 square feet of office plus the existing East-O-Lake building for a 150 seat restaurant. Later approvals were given for the shifting the restaurant into a new building out of the East-O-Lake building, for removing an entire office building due to Act 250 and for a bank that was never built as part of the Inn building. The maximum amount of trip ends from any of these proposals was 310 during the p.m. peak. In that the actual constructed square footage is 40,676 plus the 150 seat restaurant, 152 trip ends should be generated. The additional 6000 square feet of retail floor space will produce 27-42 additional trip ends or 179 to 194 • total peak hour trip ends. The additional seats should produce 6 more trip ends. These numbers are under the maximum approved to date so the traffic generation should not be a problem. Other: A sewer allocation of 750 gpd is required for the 25 additional seats. The $2.50 per gallon fee shall be paid prior to permit. See Bill Szymanski's and Chief Goddette's comments. 5) SUSAN EATON, 115 - 117 OAKWOOD DRIVE Susan Eaton, represented by Charles Deslauriers proposes to construct a 3 unit building on 2 lots on Oakwood Drive abutting I-89. The property is now zoned Residential Seven and this use will need a set back variance from the Conservation Zone along the Interstate. All of the houses in this area have received a variance from the setback. �� O Access : Access is graveled portion of CV new driveway. The property line. See shown from an 18 foot wide driveway from the Oakwood. The pavement ends 30 feet from the pavement should be extended to the southern Bill Szymanski's comments regarding this. Circulation and parking: The GMP easement covers one of these lots. No building construction is allowed. The plans show a 6 car parking lot under the power line. Landscaping A landscaping plan valued in accordance with our formula should be submitted for preliminary plat. Other: See Bill Szymanski's and Chief Goddette's comments.
