BOUNDARY LINE ADJUSTMENT FINAL PLAT APPLICATION #SD-06-80 FINDINGS OF FACT AND DECISION Charles & Patricia Shea and Steve & Jennifer Heroux, hereinafter referred to as the applicants, are seeking to amend a previously approved four (4) lot subdivision. The amendment consists of a boundary line adjustment between 670 Nowland Farm Road and 64 Shea Drive. The Development Review Board held a public hearing on September 19, 2006. Lance Llewellyn represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicants are seeking to amend a previously approved four (4) lot subdivision. The amendment consists of a boundary line adjustment between 670 Nowland Farm Road and 64 Shea Drive. 2. The owners of record of the subject properties are Charles & Patricia Shea and Steve & Jennifer Heroux. 3. The subject property is located in the Southeast Quadrant (SEQ) Zoning District. 4. The plan submitted is entitled, "Boundary Line Adjustment Plat between Lands of Charles & Patricia Shea Volume 218, Page 267 and Steve & Jennifer Heroux Volume 749, Page 295 680 Nowland Farm Road South Burlington, VT, prepared by Button Professional Land Surveyors, PC. 5. The applicant is proposing to adjust the boundary between the two properties. The lot at 670 Nowland Farm Road, also known as Lot 4, will increase by .33 acres to 1.03 acres. The lot at 64 Shea Drive, also known as Lot 1, will be reduced by .33 acres to 6.67 acres. Lots 2 and 3 are currently undeveloped and will remain as previously permitted, .74 and .69 acres respectively. 6. This is a minor property line adjustment and results in no substantial change to setbacks, coverages, or other dimensional requirements that would create non- compliance as regulated in the South Burlington Land Development Regulations. Both properties are still in full compliance with the Land Development Regulations. - 1 - #SD-06-80 DECISION y� Motion by �(� (.� �' �� seconded by to approve Final Plat Application#SD-06-80 of Charles & Patricia Shea and , teve & Jennifer Heroux, subject to the following conditions: 1) All previous approvals and stipulations shall remain in full effect, except as amended herein. 2) This project shall be completed as shown on the plat submitted by the applicant, and on file in the South Burlington Department of Planning and Zoning. 3) Any changes to the final plat plan shall require approval of the South Burlington Development Review Board. 4) The final plat plan (survey plat) shall be recorded in the land records within 180 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format. The format of the digital information shall require approval of the Director of Planning and Zoning.
