Re: Findings of Fact, application of Summer Ice Joint Venture to
amend condition #8 of the 7/30/96 revised final plat approval to
subdivide 116.7 acres of land into 12 lots, Hinesburg Road. The
amendment consists of increasing sewer allocation from 30,345 gpd
to 51,272 gpd.
On the loth day of September, 1996, the South Burlington Planning
Commission approved the request of Summer Ice Joint Venture to
amend condition #8 of the 7/30/96 revised final plat approval based
on the following findings:
The Planning Commission approved this application on July 30, 1996.
As part of the approval, the Commission granted the subdivision a
30,345 gpd sewer allocation. The applicant has since determined
that the development needs 51,272 gpd and is requesting such
allocation. Staff did not see a problem with this request and
recommended that the Commission approve the request.
DECISION & CONDITIONS
Based on the above Findings of Fact, the Planning Commission
approves the request by Summer Ice Joint Venture to amend condition
#8 of the 7/30/96 revised final plat approval to subdivide 116.7
acres of land into 12 lots to read as follows: "8. The Commission
approves a sewer allocation of 51,272 gpd. The applicant shall pay
the required sewer allocation fee prior to issuance of a zoning
permit. The length of time that this sewer allocation approval
shall remain in effect shall be tied to roadway construction. The
roadways serving this development shall be completed by 6/28/04.
The sewer allocation for any lots served by a roadway or portion of
roadway which is not completed by 6/28/04 shall be lost unless
reapproved by the Planning Commission."
