We are Judy and George Bowers. We live at 56 Bartlett Bay Road. We are requesting a variance to construct a 12' x 15' addition to our home which, if approved, will be a second bathroom and a walk-in closet. A variance is required because our property is non -conforming. Our house, originally a camp, was built closer to Lake Champlain than is now allowed by the zoning regulations. This can be seen on page one of the drawings submitted with our application. The house is set back 36 feet from the lake. We have reviewed our plans with all our neighbors. They have all have indicated they support our request. Copies of letters from the adjacent property owners and from the Mazur's are attached to this statement. Note that ouz request is very similar to one approved by this Board last year for our neighbors adjacent to the south, Jere and Carol. Meserole. Now, I will try to answer the five criteria listed in the Presentation Requirements for appellants coming before this Board. 1) The unique circumstance here is that the house on the property is non -conforming. Our home was built in the 30's as a camp and added to over the years. In the 60's, a foundation was built under the house, additions were constructed on the north and south ends, a deck was added to the Lake side, and a garage was built out by the road. We purchased the property in May of 1995 from the estate of Dr. and Mrs. Mackay. The hardship here is not being allowed to make an addition to a non -conforming structure. The modest addition we would like to construct is very consistent with the zoning regulations for conforming houses in our neighborhood. 2) Because the existing house on the property is non- conforming, there is no possibility of adding a second bathroom and being in strict conformity with the zoning regulations. As you can see from the floor plan attached to our application, page 4, it is not reasonable to try to accommodate a second bathroom within the existing footprint. C 3) The unnecessary hardship.... that being that the building on the property is non -conforming.... existed prior to our purchase of the property and was not created by us. 4) The addition we have designed is very consistent with the character of the existing structure and neighborhood. As you know, many of the houses on Bartlett Bay Road are expanded and winterized summer camps. Our goal in designing the addition was to retain the "cottagey" look of the existing house. Our lot is one of the larger lots on the road. we feel the addition we propose, if approved, will look like it has always been there. 5) The variance we are requesting represents the minimum variance that will allow us to add a second bathroom and walk-in closet. We considered several larger designs with more closet space that would have involved construction closer to our northern property line. However, we settled on the modest 12' x 15' addition which fits nicely within the current shadow of the house. we appreciate the Board's thoughtful consideration of our request. Based on the modest nature of our request, the support of our neighbors and the precedent in the Board's actions last year, we hope you will act favorably in this matter.
