She explained that they have a 61 cement wall on the side of the lot. Mr. Fayette asked if the cars would have to back out of the driveway. Mrs. Whitcomb said they would, but that it is a dead end street. Foard recessed for discussion. Mr. Burrell asked about the problem with traffic at 3:30 P.M. when Rice High School gets out. Theresa Cross stated that Rice High School got out at 2:25 -).m. Board voted unanimously to deny the request for a zoninF, variance. lst finding - Use would have definite adverse afrect on area. 2nd finding - Would change general character of area. 3rd finding - Not reasonable use for a dwelling. APPEAL OF LYDIA B. LOWELL Appeal of Lydia B. Lowell seeking a variance from Section 6.21, Lot frontage requirements of the South Burlington Zoning Ordinance. Request is for permission to construct a single family dwelling on a lot containing twenty one (21) feet of frontage of Bartlett Bay Road. Mr. Ward explained that the area is zoned Residential District E and the minimum frontage is 100 feet. The lot in question was recorded in 1930. Presently located on the lot is a camp 281 x 28', lot for camp is located on a town deeded road not accepted or maintained. Request is to remove the camp and construct a year round dwelling 621 x 2PI using the 21 foot wide town r-oad as a private drive. 6. ZONING BOARD OF ADJUbTMENT METING JUNE 73 1972 APPEAL OF LYDIA B. LOWELL, CONTINUED Frank Mazur spoke for Mrs. Lowell as he is the purchaser of the property. Mr. Myette said that 75 feet was required from the house to the high water mark. Mr. Mazur said a 950 elevation is used to establish the 75 foot mark. The house will be 15 feet from the side lines. No further support or opDosition. The Board recessed for discussion. Yr. Fayette moved to table the appeal for a further study of the property, seconded by Mr. Martineau and passed unanimously. APPEAL OF ALAN SYLVESTER Appeal of Alan Sylvester, seeking a variance from Section 5.21, Frontage requirements of the South Burlington Zoning Ordinance. Request is for permission to set-off a lot for purposes of constructirIg a sinFle family dwelling, lot contains sixty (60) foot frontage on Spear Street. Chairman Myette abstained from voting on this appeal and turned the chair over to Mr. Martineau, vice chairman. Mr. Ward said that the area is zoned Planned District and Residential District A. First 300' is residential District A. The frontage of the i3arcel is in Residential District A. Minimum frontage is 150 CD feet. Request is to set off a parcel of 18 acres with 60 feet of frontage and to construct a single family dwelling. The request has received Planning Commission approval. Mr. Martineau asked what the Planning Commission granted. 6. ZONING BOARD OF ADJUSTMENT MEETING JUNE 214_1972 APPEAL OF JAMES L. HARDY� CONTINUED_ /* Donald Hardy said he had not. James Hardy said he had spoken with the owner, but he is afraid a deeded riglat-of -way would hinder the selling of the other peoples property. Mr. Myette suggested moving over the right-of-way 10 feet and putting in a buffer of a 5 to 6 foot hedge. Mr. Myette suggested tablin.- because of discrepancies. So moved by 0 Mr. Cl,�ar.�, seconded by Mr. Martineau and so passed. APPEAL OF BRUCE LADEAU (TABLED APPEAL OF MAY 173 1972) Mr. Poger did not participate in discussion on this appeal. Appeal of Bruce R. Ladeau seeking a variance from Section 5.21, Frontage requirements of the South Burlington Zoning Ordinance. Request is for permission to set-off a lot containing approximately two and one half (2-L) acres with a lot frontage of twenty (20) feet at 1539 Hinesburg 2 Road. Mr. Ward said a legal agreement was to be drafted by Mr. Cleary and signed by Mr. Ladeau. This had not been completed at this time so Mr. Ladeau was told the,, would notify him when they were ready to sign the agreerm nt. APPEAL OF LYDIA B. LOWELL (TABLED APPEAL OF JUNE 7. 1972) Appeal of Lydia F. Lowell seeking a variance from Section 6.21, Lot frontage requirements of the South Burlington Zonin�- Ordinance. Request is for permission to construct a single family dwelling on a lot contain- ing twenty one (21) feet of frontage on Bartlett Fay Road. 7. ZONING BOARD OF ADJUSTMENT MEETING JUNE 21, 1972 APPEAL OF LYDIA B. LOWELL, CONTINUED Mr. Ward explained that on the map a correction of footage had been made. Mr. Mazur said the leach field will be on the side of the house . They will have to cut 1 birch tree and 1 pine tree on the lot. Mr. Szymanski explained that the right-of-way would have to be deeded from the city by the city council. Mr. Ward said that th,� leach field must be 100 feet from the water as stated by the Water Resources Board according to the percolation of the land. The Board voted in favor of granting the appeal with Mr. Myette, Mr. Martineau and Mr. Fayette in favor of the appeal and Mr. Cleary and Mr. Poger opposed per stipulations: 1. The leach field be located to the rear of the proposed dwelling; 2. No leaching on side lines to adjoining Droperties,and 3. The dwelling be located a minimum of 33 feet from the top of the bank as shown on the plans submitted. lst finding - As per stipulations, reasonable use of the land. 2nd finding - Lot has actual frontage of 64.27 feet on city owned, but not accepted road.
