The majority of this lot is surrounded by woods and is well screened. Discussions with the Wastewater Superintendent revealed that the only desired additional landscaping would be a continuation of the hedge along the eastern property line. The demonstration treatment facility will provide a beautifully landscaped atmosphere within the greenhouse structure. EXTERIOR LIGHTING Proposed 1. An exterior flood light is located on the east side of the proposed building. The fixture is to be down casting, high pressure sodium type with dual beam (see attached sheet). One beam is to face the new gravel parking lot and the other is to light the entrance to the proposed structure. Existin 1. Existing flood lighting is as shown on the plans and cut sheet attached. OTHER SITE IMPROVEMENTS 1. A security fence and gate will be added to separate the existing facility from the demonstration facility. This property located at 15 Bartlett Bay Road lies within the R1 District. It is bounded on the east by the Central Vermont Railway r.o.w., on the south by Bartlett Bay Road, on the west by a single y�rNr� family residence, and on the north by undeveloped property. r Access/circulation: The existing access is via a 20 foot curb cut on Bartlett Bay Road. No changes proposed. Circulation is adequate. Coverage/setbacks: Building coverage is 8.2% (maximum allowed is 15%). Overall coverage is 27.2% (maximum allowed is 25%). Overall coverage is being exceeded but since the City is not subject to its zoning regulations, this is not an issue. Front yard coverage is 21% (maximum allowed is 30%). Setback requirements are met. Landscaping: The minimum landscaping requirement, based on building costs, is $13,780 which is not being met. The applicant is seeking a credit for the $13,585 landscaping shortfall. The plantings proposed include a cedar hedge along the easterly boundary. Parking: There are no minimum parking standards for this type of facility in the zoning regulations. Six (6) parking spaces are being provided which staff feels is adequate given that the facility will have only two (2) employees. The plan should be revised to provide one (1) handicapped space. Lighting: Proposed exterior lighting will consist of the following: --- two (2) building mounted 175 watt metal halide lights with downcasting and shielded fixtures. The note on the plan referring to "flood lights" should be changed since the lights proposed are not flood lights. Dumpster: No dumpster proposed. 5) G.B.I.C. - 6 LOT SUBDIVISION - FINAL PLAT This project consists of the subdivision of a 175 acre parcel into six (6) lots ranging in size from 4.0 acres to 146.66 acres. Lot #6 is developed with the former Digital plant. The preliminary plat was approved on 1/10/95 (minutes enclosed). Access: Access to lots #1, #4 and #5 will be via access easements over the existing Digital access road. Access to lots #2 and #3 will be via a shared access on Kimball Avenue located across from Shunpike Road. Metes and bounds information for these easements should be provided on the subdivision plat. This complies with preliminary plat condition #5a. Lot size/frontage: The minimum lot size requirement of 40,000 square feet (0.92 acres) will be met. The minimum frontage requirement of 200 feet will be met for lots 1-4 and lot 6. Lot 5 will have no frontage on a public road. Lot #6 is proposed to have 1,250 feet of frontage along Kimball Avenue, approximately 700 feet of frontage west of lot #1 and 550 feet east of lot #4. The proposed trailer will be similar to a construction trailer and will have a skirt around the bottom. It's height will be 1P- 6". This will be offset from the greenhouse structure 4 or 5 feet. As you will note the footprint of the trailer is 390 sf. This trailer will replace a 500 sf wood frame structure that was attached to the backside of the greenhouse (see the previous building foot print note on the sketch). We will also be eliminating the blower/storage shed on the north side of the building. This will reduce the lot coverage by 350 sf. As I mentioned yesterday, I spoke with Don Whitten about this and he had no problem with it. The conipany has 15 employees. The Living Machine installed in South Burlington uses the natural processes found in estuaries, marshes and ponds, to treat 80,000 gallons of sewage per day. Municipal Sewage Treatment in South Burlington, Vermont Background: Built in late 1995, the South Burlington Living Machine was ramped UP to full design flow by April 1996. Water chemistry data from an EPA certified, independent laboratory demonstrates the excellent early performance of the treatment system through winter months. The Waste: This Living Machine treats 80,000 gpd of municipal sewage, an amount typically generated by approximately 1,600 residential users. The open aerobic reactors have diaphragm aerators and are planted with a variety of aquatic plant species in floating plant racks. BOD and TSS are reduced and ammonia nitrified in this stage of treatment. A clarifier follows the open aerobic reactors to settle solids. Ecological Fluidized Beds in each train follow the clarifier for final polishing. The beds operate aerobically for BOD and COD polishing, nitrification, and suspended solids digestion. Anoxic denitrification with carbon addition is carried out in the second EFB in each train. The Benefits: Solids are digested in the Living Machine treatment process to a much greater level than conventional treatment, leaving about half the amount of sludge at the end of the process. The design and construction cost for this system was $640,000, which included an additional test line for EPA funded research, a complete laboratory and a footprint large enough to accomodate tours and classroom space. Access/circulation: The existing access is via a 20 foot curb cut on Bartlett Bay Road. No changes proposed. Circulation is adequate. Coverage/setbacks: Building coverage is 10.2% (maximum allowed is 30%). Overall coverage is 35.7% (maximum allowed is 70%). Front yard coverage is 2 1 % (maximum allowed is 30%). Setback requirements are met. Landscaping: The minimum landscaping requirement, based on building costs, is $12,000 which is not being met. Chapter 11 RE: City of South Burlington 575 Dorset Street South Burlington VT 05403 Application No. 97-33, Lake Champlain, South Burlington Project: Install an Outfall Pipe and Diffuser Section for the Bartlett Bay Municipal Wastewater Treatment Plant Project Identification Number EJ95-0299 On October 3, 1997, an application was received by the Department of Environmental Conservation (Department) from the City of South Burlington (applicant) under the provisions of 29 V.S.A. Chapter 11, "Management of Lakes and Ponds," for authorization to install a new outfall pipe and diffuser section in the public waters of Lake Champlain, South Burlington, Vermont. The outfall pipe and diffuser section is for the Bartlett Bay municipal wastewater treatment plant, which is being upgraded to meet current and future wastewater treatment demands. The plant operates under a Department issued wastewater discharge permit, which is a part of the National Pollution Discharge Elimination System (NPDES). The wastewater discharge permit program is administered by the Wastewater Management Division of the Department, under the provisions of 10 V.S.A. Chapter 47. Additional information regarding the Management of Lakes and Ponds permit application was requested on October 8, 1997, and received by the Department on October 16, 1997. On October 27, 1997, state and local officials, abutting property owners, and others having an interest in this matter were notified of this application and given the opportunity to file written comments or request a public information meeting. Having received no requests for a public information meeting within the comment period provided, the Department reviewed the documents entered into the record of this proceeding and found that sufficient information exists with which to determine whether this project will be consistent with the public trust doctrine and whether the project will adversely affect the public good as provided in 29 V.S.A. Section 405(b). The Department has developed Interim Procedures to aid in the review of applications for conformance with 29 V.S.A. Chapter 11. Section 3 of these procedures, "Public Trust Determination," was invalidated as exceeding the Department's rulemaking authority in In Re- Richard and Alice. Angney (Lamoille County Superior Court, Docket No. S96-91, 9/04/92). Therefore, the Department has relied on guidance provided by case law to make a decision regarding the proposed project's consistency with the public trust doctrine. 97-33 Page 2 1. Lake Champlain, South Burlington, Vermont is "public waters" of the State of Vermont. The project encroaches beyond the shoreline as delineated by the mean water level of Lake Champlain, 95.5 feet National Geodetic Vertical Datum (NGVD). Therefore, the Department has jurisdiction under 29 V.S.A. Chapter 11. 2. Project Descriptiinn: The proposed project consists of the installation of a new outfall pipe and diffuser section for the City of South Burlington's Bartlett Bay wastewater treatment plant. The new outfall pipe and diffuser section will be made of high density polyethylene and have eighteen (18) inch interior and twenty (20) inch exterior diameters. The outfall pipe will extend 605 feet from the mean water level. The diffuser section will be attached at the lakeward end and extend an additional 101 feet into the lake. The diffuser section will have four (4) equally spaced eight (8) inch interior diameter ports. The ports will be angled up at thirty (30) degrees from the centerline of the diffuser section and point in the direction of flow. The end of the diffuser section will be closed. The outfall pipe will be buried in a trench for the first 243 feet beyond the shoreline delineated by the mean water level. The remainder of the pipe and the diffuser section will be laid on the lake bottom and held in place with precast concrete anchors, which will be placed approximately every fifteen (15) feet for a total of forty-seven (47) anchors. Burying only a portion of the outfall pipe will minimize the disturbance of lake bottom. The excavated trench will be approximately three (3) feet wide and seven (7) feet deep at the shoreline. The depth of the trench will vary, and transition to the lake bottom, or zero (0), at a point approximately 243 feet from the shoreline, at elevation 90.0 feet NGVD. Geotechnical exploration of the outfall route showed the bottom material to be mostly fine sand. Therefore, no granular bedding material is proposed to be placed in the trench bottom. The trench will be backfilled and covered with the excavated native material, which will result in a slight mound along the trench line. This mound will settle and dissipate over time. A floating silt curtain, extending to the lake bottom, will be installed in the lake around the trench area to contain turbidity during construction. Any ballast material used to secure the curtain to the lake bottom will be required to be removed as a condition of this permit. The existing wastewater discharge pipe is not proposed to be removed from the lake. This will minimize disturbance of lake bottom materials and ease the transition from the existing outfall to the new outfall and diffuser section. The overall upgrade project also includes the placement of riprap along the shoreline above the mean water level of the lake to stabilize the banks of Bartlett Brook and a portion of the lake's shoreline. This will control erosion and the discharge of sediments to the lake. 3. Project Purpose: The Bartlett Bay municipal wastewater treatment plant is currently operating such that it meets its discharge permit limitations, but with difficulty. Improvements to the wastewater treatment plant are necessary, even without increasing the treatment and discharge capacity of the treatment plant. The diffusion study titled, "Phase II, Diffuser Design and Mixing Zone Study, August 1997, " prepared by Binkerd 97-33 Page 3 Environmental, concluded that the existing single port diffuser on the existing outfall pipe would not adequately disperse and dilute the increased volume of effluent discharged from the upgraded treatment plant within the currently designated waste management zone. The increased flow velocity resulting from increased flow volume through the existing outfall would cause the effluent to be transported beyond the currently designated waste management zone before it was sufficiently diluted to meet the Vermont Water Quality Standards. The study stated that the proposed multiport diffuser would effectively dilute the plant effluent within the currently designated waste management zone to meet the Vermont Water Quality Standards. The wastewater treatment needs of the current population, as well as the needs of increasing residential and commercial development in South Burlington, require the upgrade of the wastewater treatment facility. The planned upgrade will meet the future demands on the treatment facility with a twenty (20) year design life. Concerns were raised regarding zebra mussels becoming established on the diffuser section and interfering with the flow of effluent. The wastewater treatment plant will not be using chlorine for disinfection of the effluent, so there will not be the residual concentration that exists in other effluents. Chlorine is known to discourage zebra mussels from establishing. The applicant, as a condition of this permit, will be required to periodically inspect the diffuser section to ensure that the diffuser section is functioning correctly. 4. Public Purpose/Public Benefit: The Bartlett Bay municipal wastewater treatment plant is currently operating such that it meets its discharge permit limitations, but with difficulty. Improvements to the wastewater treatment plant are necessary, even without increasing the treatment and discharge capacity of the treatment plant. The upgrade of the existing outfall will provide improved dispersion and dilution of effluent from the facility within the currently designated waste management zone. The proposed diffuser section will enable an increased amount of treated effluent to be discharged while meeting the Vermont Water Quality Standards, thereby, increasing the amount of wastewater that can be treated and discharged daily, without the need for a larger waste management zone. Development currently occurring in South Burlington includes residential housing as well as service oriented businesses open to the public, such as restaurants, hotels, and stores. The Department finds that the proposed project will create a public benefit by providing a basic service, wastewater treatment, to an increased population without increasing the currently designated waste management zone. �"3Ms m 0 6 .ii A. Excessiveness for Stated Purpose The outfall pipe and diffuser section is the minimum necessary for the discharge to meet the Vermont Water Quality Standards, with the twenty (20) year design needs of the treatment plant upgrade, without changing the currently designated waste management zone. Use of the multiport diffuser will discharge the effluent such that it can be diluted to meet the Vermont Water Quality Standards within the currently designated waste management zone. B. Less Intrusive Feasible Alternativese. No less intrusive feasible alternative has been identified that will meet the design year discharge needs. Using the existing outfall pipe would require increasing the size of the designated waste management zone, which would impact uses. Extending the outfall pipe to deeper water for sufficient 97-33 Page 4 dilution could result in the same size waste management zone, but in a new location which would impact uses and would impact more lake bottom due to the increased length of the outfall pipe. C. Measures to Reduce Impacts- A silt curtain extending to the lake bottom will be installed around the trench area to contain turbidity during construction. The outfall pipe will be buried to elevation 90.0 feet NGVD and anchored to the bottom for the remaining length, limiting the disturbance of bottom materials. Only precast concrete anchors will be used to secure the outfall and diffuser structure. The existing outfall pipe will also be left in the lake to minimize impacts to bottom materials. The City of Burlington will be operating under the conditions and limitations of the Department's wastewater discharge permit during the construction of, and transition to, the upgraded system. D. Placement of Fill: No granular bedding material is proposed to be placed in the trench bottom. The trench will be backfilled and covered with the excavated native material. Riprap will be placed along the shoreline above elevation 95.5 feet NGVD, the mean water level of the lake, to stabilize the banks of Bartlett Brook and a portion of the lake's shoreline. 6. Effects on Water Q uaL litT A silt curtain extending to the lake bottom will be installed around the trench area to contain turbidity during excavation and backfilling. Effluent discharged through the outfall pipe and diffuser section, in conformance with a Department issued wastewater discharge permit, will meet the Vermont Water Quality Standards in the currently designated waste management zone. There will be no increase in phosphorus loading to Lake Champlain as a result of this project. The overall upgrade project also includes the placement of riprap along the shoreline above the mean water level of the lake to stabilize the banks of Bartlett Brook and a portion of the lake's shoreline. This will control erosion and the discharge of sediments to the lake. No short or long term water quality problems should result from the construction or operation of the proposed project. 7. Effects on Fish and Wildlife Habitat: There will be disturbances of bottom materials during the construction period, but the bottom contours will be restored once the project is completed and settling has occurred. Over time, vegetation will reestablish over the trench and other disturbed areas. There was no information received from noticed parties, including state fish and wildlife biologists, and others to indicate that the project would have an adverse impact on fish and wildlife habitat. 8. Effects on Aquatic and Shoreline Vegetation- The lake bottom and shoreline disturbed due to construction will be restored to existing contours once the project is complete and settling has occurred. The area disturbed by construction will revegetate over time. There should be no long term adverse impacts to aquatic and shoreline vegetation due to the project. 9. Effects on Navigation and Other Recreational and Pnhlic TTcec Tnchidina Pichina and Swi ming_- During construction, navigation and boating will be impeded in the work area Once construction is completed, the outfall pipe and diffuser section should have sufficient water cover to not impact navigation, boating or fishing. This project will not change any existing impacts to swimming that may be caused by the currently designated waste J 97-33 Page 5 management zone. The completed project, when operated in conformance with a Department issued wastewater discharge permit, will meet the Vermont Water Quality Standards in the currently designated waste management zone. There should be no long term impacts on public uses from the construction or operation of the proposed project. 10. Consistency with the Natural Surrounding The outfall pipe will be buried for more than a third of its length. The rest of the pipe and the diffuser will lay on the lake bottom. The new outfall pipe and diffuser section will be located next to the existing outfall pipe. The proposed project should not adversely impact the natural surroundings. 11. Consistency with Municipal Shoreland Zoning Ordinances and Applicable State Plans- No adverse comments were received during the comment period from local and state offices and the project is thus considered to be consistent with applicable state plans. As a governmental project, the construction of the project by the applicant is not subject to any restrictions under its municipal shoreland zoning ordinance. Kedroff v. Town of Springfield (1969) 127 Vt. 624. The proposed project will be consistent with the phosphorus reduction plan in the "Opportunities for Action: An Evolving Plan for the Future of the Lake Champlain Basin, " the bi-state plan developed for the basin, as the amount of phosphorus discharged from the treatment plant will not be increased. 12. Cumulative Impact The shoreline portion of the pipe will be buried with the remainder of the pipe and the diffuser section resting on the bottom. The overall project also involves stabilization of the banks of Bartlett Brook and lake shoreline. The project should have a minimal visual cumulative impact. The installation of the new outfall pipe and diffuser section will enable the wastewater treatment plant to increase the amount of treated effluent it discharges. However, the Vermont Water Quality Standards will be met, without requiring changes to the currently designated waste management zone. The amount of phosphorus discharged from the wastewater treatment plant will not be increased over existing amounts. ,Based on the information available, the Department finds the cumulative impact of the proposed project is not adverse to the public good. Based upon the foregoing findings, it is the decision of the Department that the project described herein, as set forth in the above findings and in the plans and filings on file with the Department, complies with the criteria of 29 V.S.A. Section 405, and is consistent with the Public Trust Doctrine. In accordance with 29 V.S.A. Sections 403 and 408, permission is hereby granted to the City of South Burlington, hereinafter called "permittee," to carry out the project in accordance with the following conditions: 1. The project shall be carried out in strict accordance with the application received October 3, 1997, the letter of response received October 16, 1997, the above findings, and the conditions of this permit. Minor modifications may be approved in writing by the Department. 97-33 Page 6 2. The Department of Environmental Conservation shall be notified, a minimum of 48 hours prior to commencement of the work and following completion of the project (telephone: Water Quality Division 802-241-3777, fax 802-241-3287 weekdays). The permittee shall install a silt screen curtain in the lake around the work area prior to any excavation beyond the shoreline delineated by the mean water level of the lake. The silt curtain shall remain in place and be maintained until backfilling of the outfall is complete and turbidity has decreased to background levels. Once work commences, it shall be accomplished as quickly as possible to avoid prolonged disturbance to the surrounding area. 4. All unsuitable material shall be removed from the shorefront and disposed of properly. 5. Any ballast material used to secure the curtain to the lake bottom shall be removed from the lake. The permittee shall complete the approved construction by November 1, 2002, or this permit will expire. An extension of time may be granted for cause. A request for an extension must be received by the Department prior to the above date in order to prevent the expiration of this permit. A request for extension will be considered a minor modification. 7. Except as noted in Condition 6, this permit shall expire 15 years from the date of this permit. Upon expiration of the permit, the area shall be restored to preexisting conditions unless otherwise approved by the Department. If a renewal is desired, an application shall be filed at least 90 days prior to the expiration date. A renewal decision will be based on the relevant statutory criteria and Department rules, procedures and policies prevailing at that time. 8. The permittee shall obtain a wastewater discharge permit from the Department, under the provisions of 10 V.S.A. Chapter 47, prior to any discharge via the new outfall pipe and diffuser section. The permittee shall inspect the diffuser section annually, at a minimum, for obstructions such as zebra mussels, to ensure that the diffuser section is functioning correctly. 10. The Commissioner of the Department, or a duly authorized representative, may at any time enter the property and inspect the project, including the operation and maintenance thereof. 11. This permit and conditions are binding upon the permittee. It may not be transferred without the prior written approval of the Department. 12. This permit is issued subject to the terms herein and may be suspended or revoked at any time in accordance with the Interim Procedures for the Issuance or Denial of Encroachment Permits dated October 6, 1989 (excepting Section 3), or subsequent authority. 13. This permit does not convey any title or interest to the lands lying under public waters or waters affected, nor does it deprive the Department of the right to order the removal of the project and restoration of the area affected. I I 97-33 Page 7 14. This permit does not grant any exclusive rights or privileges which would impair any rights possessed by other riparian or littoral owners of the State of Vermont. It does not grant any right, title or easement to or over any land not owned in fee by the permittee, nor does it authorize any damage to private property or invasion of private rights or the violation of federal, state or local laws or regulations. 15. This permit does not relieve the permittee of the responsibility to comply with any other applicable federal, state and local laws, regulations and permits. 16. The Department, by issuance of this permit, accepts no legal responsibility for any damage direct or indirect of whatever nature and by whomever suffered arising out of the project described. 17. The provisions of this permit are severable, and if any provision of this permit, or the application of any provision of this permit to any circumstance, is held invalid, the application of such provision to other circumstances, and the remainder of this permit, shall not be affected thereby. 18. Special Note: Water Quality Certification: Based on information provided in the application for permit under 29 V.S.A. Chapter 11, "Management of Lakes and Ponds," public notice for which has been duly given, the Commissioner hereby certifies there is a reasonable assurance the proposed work will be conducted in a manner consistent with the applicable provisions of the Clean Water Act (42 U.S.C. § 1341). 19. This action will become effective in 10 days unless an appeal is filed with the Water Resources Board. Any person aggrieved by this decision may file an appeal with the Vermont Water Resources Board, National Life Records Center Building, Drawer 20, Montpelier, Vermont 05620-3201 (telephone 802-828-3309), within 10 days from the date of this decision. Consent Agenda: a) Site plan application of IDX Systems Corporation to amend a previously approved plan for a 120,000 sq. ft. general office building. The amendment is to 1) construct 120 lineal feet of sidewalk and 2) install a cooling tower with associated land- scaping, 1400 Shelburne Road: Mr. Burgess asked if there were any comments or questions relating to the consent agenda. She showed the possible location of a new driveway which would be put in if the neighbor moves. She also showed the right-of-way for UVM access to lot #1 which is now used. UVM is farming the land and the right-of-way is only for farm equipment. Mr. Weith suggested reserving a right-of-way for future access to lot #1. Mr. Burgess said the applicant will have to pick a time when the new access will be used. Mr. Weith suggested it be built prior to issuance of a zoning permit for lot #1. If it is built before then, UVM equipment should also use it. Mr. Burgess asked if the Gardners have a legal right-of-way to access their lot. Ms. Stratmann did not know. Mr. Teeson felt it might help to have the Gardner lot labelled so sale of it or of lot 3 or development of lot #3 might trigger using the new right-of-way. Mr. Teeson said he had no trouble with the right- of-way as long as its use is brought about by a specific event. Mr. Burgess noted that the 2 curb cuts will now be closer together. Mr. Weith said that is offset by better visibility. Ms. Stratmann questioned the size of the new right-of-way to serve lots 1 & 4. Mr. Weith said the standard is 24 ft, but the last time the Commission approved a preliminary plat they said a 20 ft. road was OK within a 40 foot right-of-way. He felt a 20 ft. road within a 30 ft. right-of-way would be OK. Ms. Stratmann asked if it could be a 10 ft. road. Mr. Weith said 10 ft. was OK until it serves more than 2 housing units. Members raised no further issues but Mr. Burgess reminded the applicant that they will have to have all details worked out when they come in for approval. 5.
