HomeMy WebLinkAboutZB-95-0000 - Decision - 0078 Barrett StreetSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 25th day of September 1995 the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of Leo and Donna Beliveau, 78 Barrett Street. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The area in question is zoned R-4 District. 2) Section 26.40 provides that a minor portion of a dwelling may be used for a home occupation which is customary in a residential area. 3) The property in question is occupied as a single family dwelling with a 161x 241 attached garage. 4) The proposed use (home bake shop) would occupy 192 square feet of the garage area. 5) The Vermont Health Department classifies the proposed home bake shop as small commercial and therefore is subject to State permit. Conclusion 1) Home occupations are not permitted within garage areas and out buildings. Home occupations are permitted as a single family use operating within a minor portion of the dwelling. 2) Converting a portion of the garage is required due to the fact that the kitchen is to small to operate the bake shop and expansion of the kitchen would be to costly. 3) There is no visible change to the outside of the structure. 4) Will not alter character of the area, this is not a retail bakery. Minimum of three deliveries weekly. fl 5) Proposed home bakery has obtained State permit from the Department of Labor and Industry and Vermont Health Department. 6) No opposition from adjoining property owners. Based upon the findings and conclusion set -forth above, the Zoning Board of Adjustment hereby grants the applicants request to operate a home bake s7hj� (containing 192 square feet) located at 78 Barrett Street.
